Privacy notice

How Martini Immobiliare handles the personal data of people who visit this site and of those who write to us through the contact, property enquiry and valuation forms.

No Data Protection Officer has been appointed: our activity does not fall within the cases where Art. 37 of the Regulation makes one mandatory. Privacy requests should therefore be addressed to the controller at the contacts above.

What we collect

This site requires no registration and creates no visitor accounts. We collect personal data only when you send it to us through one of the three forms, together with the technical data any website necessarily receives in order to answer a request.

Contact form
First and last name, email address, telephone number (optional), subject of the enquiry and the message itself.
Property enquiry
Name, email address, telephone number (optional), type of enquiry (information, viewing, offer) and the message. The reference of the listing you enquired from is attached, so that we answer about the right property.
Valuation request
First and last name, email address, telephone number (optional); the address or locality of the property and its characteristics (category, type, floor area, floor, condition, year of construction, number of rooms and bathrooms, and the other fields the form presents); whether you are the owner and, if you wish to say, your expected timescale for selling.
Technical data
IP address, date and time of the request, and the essential information your browser sends. This is what the server records in order to serve the site and to protect it from abuse (see Security and protection of the forms).

The telephone number is always optional and is labelled as such: an email address is enough for us to reply. None of the forms asks for data in the special categories of Art. 9 of the Regulation, and we ask you not to include any in the free-text message.

As you type an address into the valuation form, the text is sent to our server so it can offer completions; our server in turn queries the geocoding provider named under Who processes data on our behalf. This happens even if you then decide not to complete the request.

Estate agency work is subject to the customer due-diligence and record-keeping obligations of Legislative Decree 231/2007 on anti-money-laundering. Those obligations attach to a mediation mandate and the transactions that follow from it, not to sending an enquiry through this site. If the relationship goes ahead and completes, the data gathered at that stage is kept for ten years under Art. 31 of that decree.

The checkbox at the foot of each form is not consent to processing: it records that you were shown this notice before sending your enquiry. The processing needed to answer you rests on the legal bases set out above, not on consent, which would not be the correct basis for this purpose.

We will not send you newsletters or marketing messages: this site collects no marketing sign-ups, and the data you give us is not used for promotional purposes.

Who processes data on our behalf

Data is accessible to agency staff authorised to handle enquiries. It is not disseminated or sold to third parties for their own purposes. For the technical operation of the site and of email we rely on the providers below, which act as processors under Art. 28 of the Regulation.

All of these are IT and electronic communications providers, bound by a contract under Art. 28 of the Regulation that forbids them from using the data for their own purposes. An up-to-date list of processors, naming each provider and its country of establishment, is available on request at the contacts given under Data controller.

The maps on property pages, in the valuation form and on the Contact page load their tiles from an external mapping service. Your browser therefore contacts that service directly, and it receives your IP address. The detail is in the Cookie Policy.

Transfers outside the European Economic Area

Some of the providers listed above are established or hold infrastructure outside the European Economic Area, in particular in the United States. Where that is the case, the transfer relies on the safeguards in Chapter V of the Regulation — standard contractual clauses approved by the European Commission, or an adequacy decision, depending on the provider.

The server hosting this site, by contrast, is located in the European Union: browsing the site does not in itself involve any transfer outside the European Economic Area.

Deletion of expired enquiries is carried out by an automated routine that runs periodically against the database; it does not depend on a manual review.

Cookies and tracking technologies

The public pages of this site set no profiling cookies, use no web analytics, and host no advertising pixels or social network plugins. That is why no consent banner appears: there is no processing for which consent would be required.

The only things stored on your device support features you switch on yourself, namely the properties you save and the criteria of your last search. The full list, with its classification, is in the Cookie Policy.

Security and protection of the forms

The site is served exclusively over an encrypted connection. The database is not reachable from the browser: every read and write goes through our server, and access to the internal management system is restricted to authorised staff behind authentication.

The public forms are protected by a limit on submissions per IP address, an anti-bot check, and mechanisms that recognise repeated submissions. We process the sender's IP address for these purposes; when a submission is refused, the event is logged with the IP address alone and without the content of the message.

No profiling and no automated decision-making

We do not carry out profiling and we take no decisions based solely on automated processing that produce legal effects concerning you or similarly significantly affect you, within the meaning of Art. 22 of the Regulation.

In particular, a valuation request produces no automated estimate: the property details you send are read by a person at the agency, who replies with an indicative valuation. It is not a formal appraisal.

Your rights

As a data subject you may exercise the rights in Arts. 15-22 of the Regulation at any time, and in particular:

  • to obtain confirmation as to whether data concerning you is being processed and, if so, to access it (Art. 15);
  • to have inaccurate data corrected and incomplete data completed (Art. 16);
  • to have data erased, in the cases the Regulation provides (Art. 17);
  • to obtain restriction of processing (Art. 18);
  • to receive the data you provided in a structured format and transmit it to another controller (Art. 20);
  • to object at any time, on grounds relating to your particular situation, to processing based on legitimate interest (Art. 21).

Requests should be addressed to the email address or the certified address given under Data controller. We will reply without undue delay and in any case within one month of receipt, a period that may be extended by two months for particularly complex requests, in which case we will tell you.

Because the processing needed to answer your enquiry is not based on consent, there is no consent to withdraw. You remain free to ask us at any time to erase your data or to object to the processing.

Complaint to the supervisory authority

If you consider that the processing of your data infringes the Regulation, you have the right to lodge a complaint with the competent supervisory authority under Art. 77. In Italy this is the Garante per la protezione dei dati personali.
